Terms of Service

By creating an account, uploading a photo, browsing search results, or buying a download on Pitik Finds, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, don't use the service.

We may update these terms from time to time (see Section 15). Continued use after a change goes live counts as acceptance of the updated version.

You must be at least eighteen (18) years old and a resident of the Philippines (or another jurisdiction where we choose to offer the service) to use Pitik Finds. You must also have the legal capacity to enter into a binding contract. One natural person, one account.

Pitik Finds has three roles: photographer (uploads and sells), rider (searches and buys), and admin (internal moderation). Each account is tied to one role. You may not share credentials, sell your account, or operate multiple accounts to circumvent platform rules. You are responsible for everything that happens under your account, so keep your password safe and sign out on shared devices.

• You own the copyright to every photo you upload, or you have explicit written rights from the copyright holder to license it through Pitik Finds.
• Photos must depict roadside, public-road, meetup, or otherwise lawful motorcycle scenes consistent with the platform's purpose. No stock dumps, AI-generated fakes, or photos taken on private property without permission.
• You set your prices within the bounds offered on the dashboard. Pitik Finds takes a platform fee disclosed at checkout and on the earnings dashboard. Net proceeds are released to you as withdrawals (Section 8).
• You allow Pitik Finds to generate watermarked previews and thumbnails, to host the original on Cloudflare R2, and to deliver the watermark-free file to verified buyers.
• You must respond to legitimate takedown requests, especially from identifiable subjects in your photos. Repeated violations can result in suspension and forfeit of pending payouts.

• Photos you purchase are for personal, non-commercial use unless the photographer explicitly grants a commercial license at the time of purchase.
• No reselling, sublicensing, redistributing, or mass-sharing of purchased downloads. You may share a single copy with your immediate household and post on your personal social channels — that's it.
• Do not remove watermarks, EXIF attribution, or photographer credit where the photographer has required it.
• Chargebacks should be a last resort. Contact us first at admin@pitikfinds.com if a purchase didn't deliver what was expected.

In addition, you may not:

• Upload photos that depict minors without verifiable parental or guardian consent.
• Upload photos taken on private property without the property owner's permission.
• Upload sexually explicit, voyeuristic, or otherwise privacy-invasive content, including any image that violates a subject's reasonable expectation of privacy.
• Upload images depicting crime scenes, identifiable accident victims, graphic injury, or other content likely to cause harm or distress to subjects or their families.
• Infringe any third party's copyright, trademark, right of publicity, or right of personality.
• Harass, dox, threaten, defame, or incite hatred toward photo subjects, other users, or our team.
• Scrape, mirror, or otherwise programmatically extract photos, watermarked previews, or user data without written permission.
• Reverse engineer, bypass, or circumvent watermarks, paywalls, signed URLs, rate limits, or any technical protection measure.
• Conduct fraudulent purchases, abuse chargebacks, launder funds, or otherwise use the marketplace to disguise the origin or destination of money.
• Use the platform to impersonate any person or entity, including other photographers, riders, or Pitik Finds staff.

Violations may result in immediate content removal, account suspension or termination, forfeiture of pending payouts, and referral to law-enforcement authorities where appropriate.

Pitik Finds reserves the right to review, remove, or refuse any content, and to suspend or terminate any account, at our discretion when these terms or the law are violated. We aim to be transparent, but in serious cases (illegal content, fraud, harassment) we may act immediately and without prior notice.

If you appear in a photo on Pitik Finds and want it removed, or if you believe a photo infringes your copyright, send a takedown request to admin@pitikfinds.com with the photo URL and a clear statement of your reason. We will action verified takedowns within seven (7) business days and may hide the photo from search while the review is in progress.

For copyright complaints, please include: (a) your contact details, (b) the URL of the infringing photo, (c) identification of the original work, (d) a statement that you have a good-faith belief the use is not authorized, and (e) a statement under penalty of perjury that you are the rights holder or authorized to act on their behalf.

• All payments are processed by PayMongo. We never see or store your full card number, CVV, or e-wallet PIN.
• Pitik Finds takes a platform fee on each sale. The exact percentage is displayed on the photographer dashboard and on the buyer's checkout screen, and may change with notice.
• Photographer earnings (sale price net of platform fee and PayMongo processing fees) accrue to the dashboard balance and may be withdrawn once the configured minimum threshold is met. Withdrawals are subject to KYC checks where required by law.
• Refunds. A refund will be granted if we delivered the wrong file, if the file is corrupted, or if you were charged in error. Refunds are not granted for change of mind, buyer regret, or failure to download within a reasonable period. We may issue partial refunds at our discretion.
• Suspected fraud, chargeback abuse, or violation of these terms can result in held or reversed payouts, account suspension, and reporting to PayMongo and relevant authorities.

• Photographers retain full copyright in their photos. By uploading, you grant Pitik Finds a worldwide, royalty-free license to host, display, generate watermarked previews, deliver paid downloads to buyers, and feature your work in limited promotional contexts (with credit). This license ends when the photo is removed, except for copies retained by buyers and for archival or legal purposes.
• Riders / Buyers receive a limited, personal-use license to the photo they purchased — not the copyright. Commercial use requires a separate license from the photographer.
• Pitik Findsowns the platform, the brand, the code, the “Pitik Finds” name, logo, and visual identity. None of these may be used without our written permission.

You can close your account at any time by emailing admin@pitikfinds.com. We can suspend or terminate your account at any time for breach of these terms, fraud, abuse, or to comply with the law. In serious cases (illegal content, fraud, threats), we may act immediately and without notice.

On termination: your access ends, pending payouts may be held while we investigate any open issues, and your previously-purchased downloads remain yours under the limited personal-use license. Sections that by their nature should survive termination — IP, prohibited uses, disclaimers, limitation of liability, indemnification, governing law — survive.

Pitik Finds is provided “as is” and “as available”without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We don't warrant that the platform will be uninterrupted, error-free, secure, or that any photo you're hoping to find actually exists in our index.

We are not responsible for outages, data loss, or delays caused by third-party processors we depend on, including Supabase, Cloudflare, PayMongo, Resend, Vercel, and Google.

To the maximum extent permitted by Philippine law, Pitik Finds, its owners, and its team are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption arising from your use of the service. Our total aggregate liability to you for any claim arising out of or related to these terms is capped at the greater of (a) the total amount you paid Pitik Finds in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one thousand Philippine pesos (₱1,000).

You agree to indemnify and hold harmless Pitik Finds, its owners, employees, and contractors from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your content, including any photo you upload; (b) your use of the service; (c) your violation of these terms; or (d) your violation of any law or third-party right, including any copyright, trademark, privacy, or publicity right.

These terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or your use of Pitik Finds will be brought exclusively in the courts of the city in which Pitik Finds is operated, except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

For low-value consumer disputes, we encourage informal resolution first — email admin@pitikfinds.com before filing a case. We mean it.

We may update these terms when the platform changes, when our practices change, or when the law requires it. Material changes will be announced by email (to the address on your account) and posted on this page at least seven (7) days before they take effect. The “Last updated” date at the top of this page always reflects the current version. Continued use after the effective date of an update counts as acceptance.
